Terms and conditions
“Authorised Dealer” shallmean any third party who has a valid contract with BP and is authorised
to sell LP Gas to you and to act as an agent on behalf of BP to supply Bottles to you and to collect
the Bottle Refill Charge.
“BP” shallmean BP Oil UK Limited, or its subsidiary companies (including Handygas Limited and Macgas Limited), or its assignees.
“Bottle” shallmean the cylinder provided to you as a safemeans of transporting and storing LP Gas purchased by you.
“Bottle Refill Charge” shallmean the proportion of the price payable by you for the BP gas bottle that is an advance payment by you to BP to receive a continuing supply of LP Gas during the term of this Agreement.
“LP Gas” shallmean Butane and/or Propane gas supplied by BP in cylinder form.
“BP” shallmean BP Oil UK Limited, or its subsidiary companies (including Handygas Limited and Macgas Limited), or its assignees.
“Bottle” shallmean the cylinder provided to you as a safemeans of transporting and storing LP Gas purchased by you.
“Bottle Refill Charge” shallmean the proportion of the price payable by you for the BP gas bottle that is an advance payment by you to BP to receive a continuing supply of LP Gas during the term of this Agreement.
“LP Gas” shallmean Butane and/or Propane gas supplied by BP in cylinder form.
1. An Authorised Dealer acting on BP’s behalf shall supply you with the Bottles as detailed in your
receipt of sale, together with replacement Bottles as supplied in accordance with Clause 2,
from the date specified on the receipt of sale until this Agreement is terminated in accordance
with this Agreement.
2. An Authorised Dealer acting on BP’s behalf shall provide you with a replacement Bottle to refill an empty Bottle where you purchase LP Gas from BP or an Authorised Dealer at current prices for LP Gas. Bottlesmay only be exchanged on the basis of one full for one empty Bottle of the same size and type but BP reserves the right to refill a Bottle by any othermeans.
3. BP or an Authorised Dealer shall not deliver the Bottles to your premises unless specifically agreed between us.
4. (a) All Bottles supplied to you in accordance with Clauses 1 and 2 remain the property of BP and are not transferable. This Agreement is not a rental agreement between us. (b) You shall not during the period of this Agreement sell, offer to sell, lend, rent, dispose of or part with the possession of the Bottles or give or allow anyone to obtain any legal right over the Bottles without the prior consent in writing of BP.
5. (a) You shall not return the Bottles to anyone but an Authorised Dealer. (b) The Bottlesmay be returned by you to an Authorised Dealer at any time and thereupon this Agreement shall terminate. (c) If the Bottles are in good condition when returned pursuant to Sub-clause (b) you will be refunded 50% of the deposit.

An Authorised Dealer acting on BP’s behalf shall provide you with a replacement Bottle to refill an empty Bottle where you purchase LP Gas from BP or an Authorised Dealer at current prices for LP Gas. Bottlesmay only be exchanged on the basis of one full for one empty Bottle of the same size and type but BP reserves the right to refill a Bottle by any othermeans.
3. BP or an Authorised Dealer shall not deliver the Bottles to your premises unless specifically agreed between us.
4. (a) All Bottles supplied to you in accordance with Clauses 1 and 2 remain the property of BP and are not transferable. This Agreement is not a rental agreement between us. (b) You shall not during the period of this Agreement sell, offer to sell, lend, rent, dispose of or part with the possession of the Bottles or give or allow anyone to obtain any legal right over the Bottles without the prior consent in writing of BP.
5. (a) You shall not return the Bottles to anyone but an Authorised Dealer. (b) The Bottlesmay be returned by you to an Authorised Dealer at any time and thereupon this Agreement shall terminate. (c) If the Bottles are in good condition when returned pursuant to Sub-clause (b) you will be refunded 50% of the deposit.
6. You shall:-
(a) Pay the Bottle Refill Charge and VAT charged at the applicable rate.
(b) Keep the Bottles in good and substantial repair and condition (fair wear and tear only
excepted).
(c) Comply at all times with the safety advice and requirements set out in this leaflet.
(d) Permit BP its servants or agents at all reasonable times and on reasonable notice
(except in emergencies) to have access to the Bottles for the purpose of inspection repair
ormaintenance.
7. This Agreementmay be terminated: (a) By you in accordance with the provisions of Clause 5(b) above. (b) By BP at any time without notice in the event that you are in breach of your obligations under this Agreement or any of the safety instructions or BP or its Authorised Dealer reasonably believes that youmay bemishandling or interfering with the Bottle. The Bottles will remain the property of BP.
8. Upon termination of this Agreement for whatever reason all Bottles in your possessionmust be returned to BP or an Authorised Dealer immediately.
9. (a) BP shall not be liable for any loss damage or injury to persons or property arising from the use or storage of Bottles or LP Gas unless caused by the proven negligence of BP. (b) BP shall in no circumstances be liable for any losses arising from the use or storage of Bottles or LP Gas which are related to your business (such as loss of profits, loss of opportunity, loss of business, increased business costs and expenses, loss of production or business interruption).
7. This Agreementmay be terminated: (a) By you in accordance with the provisions of Clause 5(b) above. 10. Any time or other indulgence granted by BP to you shall not affect the enforcement of the strict
rights of BP hereunder.
11. This Agreement shall be governed by English Law where the Bottles are purchased from an Authorised Dealer in England and by Scottish law where the Bottles are purchased from an Authorised Dealer in Scotland.
